The DLC was chartered in 1974 by the 7 shore line towns. Our mission is to provide leadership, guidance, and resources to preserve and restore Deal Lake and its tributaries as a healthy and stable ecosystem. In addition, control lake levels during heavy storms to the best of our ability with limited ocean tide controls.

    Deal Lake, its tributaries and watershed are regulated by Federal and State agencies. Check before you dig.

    Strict compliance with the NJDEP regulations apply to any land 50 feet adjacent to the Deal Lake shoreline as well as any land 50 feet adjacent to any stream that drains into Deal Lake.

    Property owners should contact the NJDEP before beginning any maintenance or any construction along the lake's shoreline.

    There can be consequences, including fines and time delays for proceeding with work, prior to securing the appropriate NJDEP permit(s).

    MINUTES – REGULAR MEETING

    MARCH 16, 2023

     

    Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform.  The Commission Chairman called the meeting to order at 7:00 PM.  After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 2, 2022, posting where required and filing a copy of the notice with the Commission Clerk.  The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

    Resolution #23-025 – Resolution to Approve the Minutes of the Regular Meeting

    Jeannie Toher, City of Asbury Park Commissioner, pointed out that a correction needs to be made to the Minutes from the February 16, 2023 Meeting.  The date for the Workshop Meeting should read April 20.  The Commission Clerk will make that correction.

    OLD BUSINESS

     

    1. 2107 – 319(H) Grant – Peter Avakian, Commission Engineer, gave a brief update on the project. Right now we are addressing some utility and site issues, but once they are resolved the work should begin around April 4th. We should be finished by the end of the month.  He hopes to be talking about the project being completed and closed out at our next meeting.

     

    1. Shoreline Protection/Education – No updates from the State.

     

    Ms. Toher reported that she has not received a response to the letter that was sent.  She will give it a couple more days and then resend it.

     

    1. Goose/Carp Remediation – Ms. Toher read from a prepared statement regarding the DLC and USDA working together on goose remediation around the lake this season. She went on to read how the process works.  It can all be found the DLC website.

     

    Carolyn Roarty, Commissioner for the Borough of Interlaken, suggested discussing how we can reach property owners along the lake that are not here year-round to get them to sign the permission slips.

     

    Mr. Brockel announced the return of the Carp Contest on April 15th sponsored by the Asbury Park Fishing Club.  In the past the DLC has donated the trophies and he would like to see us do the same thing this year.

                UPON MOTION of Allenhurst, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:

     

    WHEREAS, the Asbury Park Fishing Club’s Carp Fishing Contest in Deal Lake is back this year and will be held on Saturday, April 15, 2023;

     

    NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commissioners that the Deal lake Commission will provide the trophies for the Carp Contest sponsored by the Asbury Park Fishing Club on Saturday, April 15, 2023 in an amount not to exceed $400.00.

    1. Restoration of 4 lakes/ponds west of Wickapecko – No Update.

     

    1. Water Testing: Monmouth University – Dr. Souza will co-present with Dr. Adolf at a  Workshop prior to the April 20th meeting at 6:15 PM.  The title of the presentation is “How does the Coastal Lake Observing Network (CLONet) Fit into Deal Lake Restoration Plans?”

     

    1. New DEP Stormwater Management Grant – Mr. Brockel reported we have been contacted by the State to make some minor changes to our submission. Dr. Souza gave a brief explanation of the changes.  Once the changes are complete we will send it back to the State.  After that it could still be three or four months before we get an executed contract to proceed.

     

    1. JCP&L Violation Update – Dr. Souza said the DEP did recognize that what JCP&L did was an unpermitted discharge and they did issue them a Notice of Violation. JCP&L’s response was that they were doing routine maintenance of the utility vaults.  There is no proof and we can’t go back, so it remains an unresolved issue.  In the future they should require them to have some sort of silt sock that the water is pumped through.

     

    There was more discussion on this subject.

     

    Mr. Brockel reported that the construction going on at the old coca cola plant is going well and they are doing a great job with their stormwater management.

     

    Mr. Avakian said activity has stopped this past week on that project and there has been no explanation why.

     

    1. 2023 Spring Clean-up – Saturday, March 25th 9:00AM to Noon. Not just the water but the shoreline as well.

    NEW BUSINESS

     

    1. Carp Contest – Discussed under Item #3 on the Agenda.

     

    1. School Funds Available for Education via the State – Mr. Brockel said there is a grant available which seems to be focused towards Asbury Park and possibly Monmouth University. He did send it to Kevin Gold from Asbury Park High School. The Grant reads – DEP seeks partners to build next generation environmental leaders from overburdened communities.  He also sent it to Dr. Adolf.

     

    1. Deal Lake Watershed Alliance – Mr. Brockel said we helped the DLWA with a grant request last month. It was for work at the park by Colonial Terrace. It has been submitted, not sure if they received the grant.

     

    1. Mr. Brockel spoke about some recent issues along the shoreline with a house in West Allenhurst. The new owner has removed a lot of the vegetation and did some construction on the shoreline as well.

     

    Ms. Roarty spoke about the trees that were cut down on South Edgemere along the water line. She took pictures and sent them to the Chairman.

     

    Mr. Brockel shared the pictures and explained that this is a Township of Ocean project.  The road was caving in and they will be putting in a bulkhead.

     

    The Commission Clerk read from a memo that was prepared by the Township of Ocean’s tree expert regarding the project.  The memo will be attached at the end of the Minutes.

     

    Mr. Brockel thanked the public for calling him to alert him to the trees being cut down.

     

    1. Dr. Souza announced that an ANJEC Grant is available right now for environmental commissions. The link is available on the chat on the DLC website.

     

    COMMISSIONER’S LAST WORD

     

    Jeannie Toher, Asbury Park Commissioner, again wanted to remind everyone of the Workshop Meeting prior to the April 20th  DLC Meeting.  The Workshop will begin at 6:15 PM.

     

    Carolyn Roarty, Interlaken Commissioner, announced that no real work can take place on the lake after March 31st because it’s spawning season for fish.

     

    Margot Fernicola, Loch Arbour Commissioner, announced Clean Ocean Action Beach Sweep, April 1st, from 9 am to 12:30 pm.  Also, there is a lifetime Loch Arbour resident who is a sophomore at University of Vermont that would like to do some type of internship this summer

    and wondered if Deal Lake had one.  He is an environmental science major.

     

    Bruce Fromer, Allenhurst Commissioner, asked how come the DLC is not alerted when projects such on the one in Ocean Township is going to take place that will affect the lake.  There should be some form of communications with the towns so that the DLC could have input with these types of projects.

     

    Prior to the opening of the Public Hearing the Commission Clerk reminded everyone of the Resolution that was passed on March 18, 2021 that limits the public comments made per person to three (3) minutes.

     

     

    PUBLIC HEARING

     

    UPON MOTION of Neptune, seconded by Loch Arbour, moved that the meeting be opened to the public.

     

    Bob Jaroszewski, an Ocean Township resident, said the DLWA submitted the application and they have not heard anything yet.  He introduced Jen Zarcone from the non-profit organization called Safe Coastal Wildlife.  One of the things that her organization does is build and put up osprey nests.

     

    Jen Zarcone, is also an Ocean Township resident and has volunteered for the water quality testing as well.  She has been watching the osprey nests for years and has been trying to get JCP&L to get them off the power lines.  JCP&L is supposed to build them new platforms when they remove an active nest, but so far they have not done so. She hasn’t been able to get anywhere with JCP&L.  She was wondering if the DLC had any suggestions for places to put platforms for the birds that are safe and how we can get permission to put them up.

     

    Mr. Brockel gave her some contacts and suggestions of safe spots around the lake for the platforms.

     

    Gail Rosewater, Wesley Lake Commission, announced that there will be no clean-up on March 25th by Wesley Lake.  She spoke briefly about the meeting at Asbury Park City Hall last night about the participatory budget where the City of Asbury Park is making $250,000.00 available for the residents of Asbury Park to vote on various projects that were submitted by City residents.  There were a number of presentations that pertained to Deal and Sunset and she advised the group after the meeting to work in conjunction with the commissions, in particular the Deal Lake Commission.

    Mr. Brockel said we officially know nothing.  They should have the Commissions approval before they move forward with any of the projects along the lake.  Mr. Brockel thanked her and asked Ms. Toher to look into this before the committee chooses the projects.

     

                There being no further comments and UPON MOTION of Allenhurst, seconded by Neptune, carried that the public hearing be closed.  There being no further business and UPON MOTION Allenhurst, seconded by Asbury Park, carried that the meeting be finally adjourned at 8:07 PM.
