Our mission is to provide leadership, guidance, and resources to preserve and restore Deal Lake and its tributaries as a healthy and stable ecosystem. In addition, control lake levels during heavy storms to the best of our ability with limited ocean tide controls.

    Strict compliance with the NJDEP regulations apply to any land 50 feet adjacent to the Deal Lake shoreline as well as any land 50 feet adjacent to any stream that drains into Deal Lake.

    Property owners should contact the NJDEP before beginning any maintenance or any construction along the lake's shoreline.

    There can be consequences, including fines and time delays for proceeding with work, prior to securing the appropriate NJDEP permit(s).

    September 17, 2020

     

    Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting platform.  The Commission Chairman called the meeting to order at 7:00 PM.  After the salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act (C.231, P.L. 1975), were met by transmitting the notice to the Commission’s official newspaper on January 30, 2020 and revised on September 17, 2020, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 30.

    OLD BUSINESS:

     

    1. Flume Electrification – Don Brockel, Commission Chairman, reported that the project is 90% complete. The cameras are installed and working. He gave a brief explanation of how the cameras work.

     

    Peter Avakian, Commission Engineer, said they met with the Contractor on-site September 11th to develop a punch-list of items that still need to be completed.  The punch-list was broken down into two parts.  The surge chamber and the gatehouse.  He said part of the work that needs to be done will require the lowering of the lake.

     

    Mr. Brockel said the lake lowering can be coordinated with our fall lake clean-up.

     

    Resolution #20-057 – Authorizing the Commission Clerk to Advertise the Fall Clean-Up

                                        and Lake Lowering

     

    UPON MOTION of Interlaken, seconded by Asbury Park, carried that the following Resolution be and the same is hereby adopted:

     

    WHEREAS, the Deal Lake Commission sponsors an annual fall clean-up to remove accumulated debris and trash from the watershed; and

     

    NOW, THEREFORE, BE IT RESOLVED that the 2020 Fall Clean-Up be scheduled for October 31, 2020 from 9:00 AM to Noon and the Commission Clerk, be and she is hereby directed to place an ad in The Coaster and The TriCity News to include information noted above and alerting the residents of the lake lowering regarding the October 31st Clean-Up in an amount not to exceed $500.00.

    Mr. Avakian said we can’t lose sight of the fact that the project is being funded by the ACoE and needs to be completed before the end of the year.

     

    1. 319(H) Grant – Mr. Avakian reported that the bids came back for the MTD’s and the lowest responsible bidder was Precise Construction, Inc., which is the same contractor that is doing the flume electrification project. He gave a brief summary of the projects that Precise Construction has done in the area.  He said because the bid came back $50,000.00 lower than projected, it allows us to focus a little more on Wesley and Sunset lakes.

     

    There was a brief discussion on the location of the three MTD’s.

     

    Resolution #20-058 – Award of Bid for Stormwater Treatment Devices in the Deal Lake

                                        Watershed

     

                UPON MOTION of Allenhurst, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:

     

    WHEREAS, the Deal Lake Commission authorized the Commission Engineer to advertise for the receipt of bids for Stormwater Treatment Devices in the Deal Lake Watershed on July 16, 2020; and

     

    WHEREAS, the Commission Engineer did duly advertise to receive bids for Stormwater Treatment Devices in the Deal Lake Watershed in The Coaster on August 6, 2020; and

     

    WHEREAS, in connection herewith four (4) prospective bidders picked up the bid documents:  Precise Construction, Inc., Freehold, NJ, Underground Utilities Corp., Linden, NJ, Marboro, Inc., Montclair, NJ, T.R. Weniger, Inc., Piscataway, NJ; and

     

    WHEREAS, three (3) bid proposals were received on August 27, 2020:  Precise Construction, Inc., Freehold, NJ – $297,219.00; Underground Utilities Corp., Linden, NJ – $474,650.00; Marboro, Inc., Montclair, NJ – $611,117.00; and

     

    WHEREAS, the Commission Engineer has recommended that a contract for the Stormwater Treatment Devices in the Deal Lake Watershed be awarded to Precise Construction, Inc., Freehold, NJ as per their bid proposal for the Stormwater Treatment Devises in the Deal Lake Watershed at a cost not to exceed $297,219.00, subject to the review and approval by NJDEP; and

    Jack Szczepanski, Commission Environmental Consultant, who is responsible for the green environmental phase of the project, said because the price for the MTD’s came in lower we will have money to use for the bio-infiltration system at Wesley Lake and tree boxes around the watershed.  We received the 6th Quarter payment in the amount of $58,629.32 and in speaking to NJDEP it included the $18,888.76 for the Floating Wetland Islands (FWI’s) for Sunset Lake.  He reached out to the manufacturer of the FWI’s and asked if we could pay for it now and have them shipped in the Spring.  In speaking to the representative from the FWI’s they have since developed a process to armor the FWI’s, which provides for better UV protection and more durability for the islands.  The total increase for the FWI’s would be approximately $1,430.00 which would bring the total cost of the FWI’s to $20,241.33.  We have $37,000.00 in the budget for the FWI’s and the cost of the plants is minimal.

     

    Bruce Fromer, Borough of Allenhurst Commissioner, asked for an explanation of an FWI.

     

    Dr. Szczepanski explained that they are manufactured islands that are planted with plants and placed in the water.  When they are floating in the water they take the pollutants from the water, which helps the plants grow.  It removes the nitrogen and phosphorus from the water, so instead of feeding the algae its feeding the plants.

     

    Resolution #20-059 – Authorizing the Purchase of Six (6) Floating Wetland Islands

    WHEREAS, the Deal Lake Commission as a cooperative effort with the Sunset Lake Commission and Wesley Lake Commission was awarded a 319(H) Grant to implement various

    WHEREAS, part of the 319 (H) Grant includes Floating Wetland Islands to be installed on Sunset Lake and Wesley Lake; and

     

    WHEREAS, a quote was received from Midwest Floating Island, Saint Paul, MN for six (6) Floating Wetland Islands in the amount of $18,888.76 and the option of tops and side armor in the amount of $1,428.25 for a total amount of $20,317.01; and

     

    NOW, THEREFORE BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes the award of the contract for six (6) Floating Wetland Islands with the option of the tops and side armor to Midwest Floating Island, Saint Paul, MN in an amount not to exceed $20,317.01; and

     

    BE IT FURTHER RESOLVED that a certified copy of the Resolution shall be forwarded to the following:

    Resolution #20-060 – Authorizing Realignment of Bench and Trash Receptacles for the

                                        Tree Planting Project in the Village of Loch Arbour

     

                UPON MOTION of Ocean, seconded by Allenhurst, carried that the following Resolution be and the same is hereby adopted:

     

    WHEREAS, the Deal Lake Commission accepted a donation of $30,000.00 from Kassin Beach, LLC for landscaping improvements to Deal Lake in the Village of Loch Arbour by way of Resolution #19-025 dated March 21, 2019; and

     

    WHEREAS, Environmental Landscape Design, Wall, New Jersey was awarded the contract in the amount of $22,391.00 by way of Resolution #19-026 dated March 21, 2019; and

    WHEREAS, there existed a need to maintain the landscape project; and

     

    WHEREAS, Environmental Landscape Design, Wall, New Jersey submitted a proposal dated February 14, 2020 for the Spring Plant Care for the Loch Arbour Tree Planting Project at Deal Lake in the amount of $1,200.00; and

     

    WHEREAS, Resolution #20-058 awarding the contract for the 2020 Spring Plant Care for the Loch Arbour Tree Planting Project at Deal Lake to Environmental Landscape Design, Wall, New Jersey in an amount not to exceed $1,550.00 was adopted at the Deal Lake Commission Meeting of May 21, 2020; and

     

    WHEREAS, a request was made to realign some of the benches and receptacles that were placed at various locations along Deal Lake in the Village of Loch Arbour; and

     

    WHEREAS, Environmental Landscape Design, Wall, New Jersey, submitted a proposal in the amount of $625.00 for the realignment of the benches and trash receptacles for the Tree Planting Project in the Village of Loch Arbour; and

     

    WHEREAS, the funds for this

    project will be provided from the 2020 Budget of the Deal Lake Commission Lake Maintenance account; and

     

    NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it does hereby authorize Environmental Landscape Design, Wall, New Jersey to complete the realignment of the benches and trash receptacles for the Tree Planting Project in the Village of Loch Arbour in an amount not to exceed $625.00.

    1. Water Testing/Monmouth University – Mr. Brockel announced that Dr. Jason Adolf from Monmouth University will be at the next meeting to discuss the Clonet program.

     

    1. Ship & Sniff Program with Clean Ocean Action – Mr. Brockel said there is no update. A leaky sewer line was discovered in Interlaken and has since been fixed.

     

    1. Seaview Mall Update – Mr. Brockel said there is no update but conditions are improving.

     

    1. 2020 Weed Treatment – Mr. Brockel said that Solitude Lake Management, the company that did the 2020 Weed Treatment will submit its report for the next meeting.

    Resolution #20-061 – Authorizing the Preparation of the 2021 Weed Treatment Request

    WHEREAS, the Deal Lake Commission wishes to address the problem of excessive weed growth at various locations on Deal Lake; and

     

    NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes Dr. Stephen J. Souza, Environmental Consultant to the Deal Lake Commission to prepare a Request for Proposals for the 2021 Weed Treatment Program at various locations on Deal Lake.

    1. 2020 Assessment Update – The Commission Clerk reported all 2020 Assessments have been paid.

     

    1. Phase 1 319: New 319 effort with NJIT – Dr. Souza said they met with the group from NJIT and he proceeded to give a brief explanation of the project.  There will be more information on this in the next few months.

     

    1. Nobility Crest – Hunt Parry, Commission Attorney, reported that he has a letter ready to go, but there is still a little more legwork that needs to be done. It’s difficult to get the information he needs because a lot of offices still are not open due to COVID-19.

     

    1. Signs – Mr. Brockel said he is still in the process of getting quotes for the signs.

     

    1. Goose Remediation – Mr. Brockel reported that the Wesley Commission has installed the lights on the lake and it appears to be working in getting rid of the geese. He would like to see this technology used at some of the areas of the lake that have serious geese problems.

     

    Ms. Toher suggested focusing on more effective methods such as egg addling, to prevent the geese from becoming a problem.

    NEW BUSINESS

     

    1. Shoreline Protection /Education – Mr. Brockel said that he, Dr. Souza and Jeannie Toher, Asbury Park Commissioner, are working together on trying to educate the public and the towns on some serious issues that need to be addressed on the lake.

     

     

    Dr. Souza said one of the primary problems is trying to lock down and identify the key people from DEP.  The regulations need to be clear on what can and can not be done on the lake.

     

    1. DLWA Rain Garden Status – Mr. Brockel said he is waiting for a briefing from the DLWA on the project.

     

    Dr. Souza said the work is being done through a grant they received from Rutger’s University.

     

    Ms. Toher showed a picture of the Eastern Redbud tree that has been proposed to be planted on Deal Lake Drive by the Asbury Park Environmental Shade Tree Commission as part of their “Remember Me” project.

     

    1. Boating Issues – Mr. Brockel said there have been a lot of boating issues on the lake. He is urging people to call the Police if they see something.  He is hoping to have a Zoom meeting with the Borough of Deal and the Township of Ocean Police Departments to address this problem.

     

    1. Otters – Mr. Brockel said that there are now four or five otters that have been seen swimming in the lake.

     

    1. Organic Material Removal/Restoration of Four Western Retention Ponds – Mr. Brockel said we will be focusing on the four ponds that need to be fixed. This item will be discussed at a future meeting.

     

    1. Resolution #20-062 – Authorizing a Tentative 2021 Meeting Schedule

    PUBLIC HEARING

     

    UPON MOTION of Ocean, seconded by Interlaken, carried that the meeting be opened to the public for comments:

     

    Nancy Ehrlich, had questions, comments and concerns regarding the jet-ski’s on the lake.

     

    Mr. Brockel said we can’t say no jet-ski’s allowed but, we can place 5 mile per hour signs by the bridges.

     

    Ms. Ehrlich, had a report from the DLWA: They will begin working on the rain garden October 7th.  There will be a native plant expert who will be there to help remove the non-native plants and recommend what plants to keep.  We are also still working on a kayak launch in that area.

     

    Bob Ehrlich, reported on the DLWA paddle this past weekend.  It was very successful.  They spotted 2 black belly whistling ducks.  There is a lot of great wildlife this year.

     

    Ms. Toher, thanked them for all of their great work.

     

    Marty Martino, reported that he made a proposal to the Ocean Township Council regarding his proposed First Responders Park at Fireman’s Pond.  They are going to review his proposal.

     

    Mr. Brockel said he would work something up with Marty to present to the Ocean Township Council at one of their October meetings.

     

    Melanie Nowlin, Loch Arbour, was happy to hear that the problems with the jet-skis’ and the boats are being addressed.

     

    There was more discussion on the concerns and issues with the jet-ski’s and boats.
