The DLC was chartered in 1974 by the 7 shore line towns. Our mission is to provide leadership, guidance, and resources to preserve and restore Deal Lake and its tributaries as a healthy and stable ecosystem. In addition, control lake levels during heavy storms to the best of our ability with limited ocean tide controls.

    Deal Lake, its tributaries and watershed are regulated by Federal and State agencies. Check before you dig.

    Strict compliance with the NJDEP regulations apply to any land 50 feet adjacent to the Deal Lake shoreline as well as any land 50 feet adjacent to any stream that drains into Deal Lake.

    Property owners should contact the NJDEP before beginning any maintenance or any construction along the lake's shoreline.

    There can be consequences, including fines and time delays for proceeding with work, prior to securing the appropriate NJDEP permit(s).

    MINUTES – REGULAR MEETING

    APRIL 18, 2024

     

    The Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform.  The Commission Chairman called the meeting to order at 7:00 PM.  After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 1, 2024, posting where required and filing a copy of the notice with the Commission Clerk.  The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

    OLD BUSINESS

     

    1. 319(H) Grant (2017) – Don Brockel, Commission Chairman, reported that he will be drafting a letter requesting a six months extension after our new Grant Manager had a few questions on the final submission.

     

    Peter Avakian, Commission Engineer, reported everything has been submitted, just waiting for them to sign off.

     

    1. New DEP Stormwater Management Grant – Mr. Avakian explained that Dr. Souza (Commission Environmental Consultant), provided the DEP with an initial breakdown on the project and it is now being reviewed. In the meantime, his office has begun surveying basin and MTD layout off the loop road at Seaview Square Mall. Upon formal authorization from DEP, we will proceed.  We do have a Notice to Proceed but no signed Contract.  He hopes to have some draft plans to present at one of our next in-person meetings.

     

    1. Shoreline Protection/Education – Mr. Brockel said he still has not heard back from the DEP on the 8 or 9 violations that were reported to them.

     

    Jeannie Toher, City of Asbury Park Commissioner, did reach out again to the DEP and has not heard back.

     

    1. Goose/Carp Remediation – Mr. Brockel said the geese are very active and there are a lot of nests. The team from the USDA is working on it and letters are being dropped off to homeowners along the lake for their signature.  Ms. Toher is working with the Board of Education is Asbury Park to get them to sign off on a letter.  There are some nests by the shoreline at the High School.

     

    1. 2024 Weed Management Program – After a brief discussion and an explanation of the product used for the treatment, the Commissioners were in favor of having Lake Management Sciences treat the lake again this year.

     

    1. Marine Safety Rules on Deal Lake – Mr. Brockel has reached out to the Marine Safety Commission requesting changes be made to the jet skis and personal watercraft on the lake. He did find out that our request has been submitted but it could take a year or two for any new rules.

     

    1. Renewal of the 2025-2035 Agreement for the Reestablishment of a Joint Meeting known as the Deal Lake Commission – Mr. Brockel will work on the letter and send it to the Clerk for her

    to send to the Municipalities.  The Clerk will also send copies of the letters that were sent to each Commissioner.

     

    1. Lake Oil Spill March 10, 2024 – Mr. Brockel gave a brief update on the oil spill on Memorial Drive in Asbury Park. Our Manufactured Treatment Device (MTD) helped contain the spill and avert a potential disaster. He went on to explain the remediation work that has been and will be done.

     

     

    NEW BUSINESS

     

    1. May and July Meetings – The May and June meetings will be hybrid. The July meeting will be Zoom.

     

    1. Flume Repair -Mr. Brockel reported that after a recent rainstorm he had Raritan Valve come to do a grease job on our system at the flume and a potential problem was discovered with the mechanical actuator. It turns out, it was not as bad as they first thought.  They need to come back and re-align it.  We will be lowering the lake so they can fix the problem.

     

    Ms. Toher suggested letting the public know when the lake will be lowered to fix the flume.

     

    1. Approval for Team Viewer – Mr. Brockel said he has been using a free software link for our remote operations of the Flume and has been getting kicked off a lot. He would to like to continue using TeamViewer at a cost of $298.80 per year.

    Asbury Park offered, Interlaken seconded, that we use Team Viewer for a year’s service of remote operations at a cost of $298.80.

    1. Clean Ocean Action – Mr. Brockel explained that we have been using Clean Ocean Action for the past few years to help identify hot spots on the lake. He just received a Proposal from Clean Ocean Action to do Phase III at a cost of $6,300.00.  He will send out the Proposal to the Commissioners and we can discuss it at the next meeting.

     

    1. Mr. Avakian has received two phone calls recently regarding the ownership of the flume and gatehouse. It has been discussed over the years but he suggests forming a committee along with Hunt Parry, the Commission Attorney to come up with an official response from the Deal Lake Commission as to the ownership.

     

    There was more discussion on the flume, the dam, and its ownership.

    1. General Liability Insurance – Mr. Brockel reported on the discussions he has been having with the State and their insistence that the DLC have General Liability Insurance. He has spoken to other lake commissions and they all have insurance. Right now, we only have Errors &

    Omissions Insurance.  He has submitted the paperwork to our insurance carrier and is waiting for the quote, which should not be more than $3,300.00.  It would cover not only the Flume and Gatehouse but our clean-ups as well.  The Commissioners agreed on purchasing general liability insurance.

     

    Resolution #24-033 – Authorizing the Purchase of General Liability Insurance at a

                                        Cost not to exceed $4,000.00

     

                UPON MOTION of Asbury Park, seconded by Allenhurst, carried that the following Resolution, be and the same is hereby adopted:

     

    WHEREAS, the Deal Lake Commission is need in of purchasing General Liability Insurance; and

     

    NOW, THEREFORE, BE IT RSOLVED by the Deal Lake Commission that it hereby authorizes the purchase of General Liability Insurance at a cost not to exceed $4,000.00.

    Margot Fernicola, Village of Loch Arbour Commissioner, asked who owns the flume.

     

    Mr. Avakian, said we just don’t know which municipality the flume is located in and who owns it.

     

    COMMISSIONER’S LAST WORD

     

    Carolyn Roarty, Borough of Interlaken Commissioner, wanted to mention that the DLC’s 50th Anniversary is this year and we should look to have some fun festivities, commemorative merchandise, etc.

     

    Jeannie Toher, City of Asbury Park Commissioner, is glad to see that the owners of oil spill took responsibility and were proactive in the remediation.

     

    Bruce Fromer, Borough of Allenhurst Commissioner wanted to comment on the number of trees that have been removed around the lake.  He also mentioned that he spotted a beautiful brown bird flying around the lake and wondered if anyone could identify it.

    A few of the Commissioners and Bob J. also spotted the bird and identified it as a young bald eagle.

     

    Ms. Toher wanted to remind everyone of the pamphlets that were done and distributed to the municipalities regarding tree removal.

    UPON MOTION of Allenhurst, seconded by Interlaken, moved that the meeting be opened to the public.

     

                There being no further comments and UPON MOTION of Ocean, seconded by Interlaken, carried that the public hearing be closed.

     

    1. Muthukrishnan, asked about tree ordinances and stormwater management rules that municipalities must have in place by May 31st. Asked if all the towns are updated on the ordinances.

     

    Mr. Brockel explained that some municipalities have adopted tree ordinances.

     

    Melanie Nowlin, Loch Arbour, asked when the Carp Contest will be this year?

     

    Mr. Brockel said it has not been scheduled yet.

     

    Bob Jarozwski, Ocean, announced the following:

    • May 18th – Deal Lake Paddle 9:00 AM – more details to follow
    • May 19th – Greenfest at Joe Palaia Park in Ocean Township from 10:00AM – 2:00PM. There will also be a 5k race.

     

    Melanie Nowlin, Loch Arbour, wanted to discuss trees and tree ordinances.

     

    There being no further business and UPON MOTION Ocean, seconded by Interlaken, carried that the meeting be finally adjourned at 8:02 PM.
