The DLC was chartered in 1974 by the 7 shore line towns. Our mission is to provide leadership, guidance, and resources to preserve and restore Deal Lake and its tributaries as a healthy and stable ecosystem. In addition, control lake levels during heavy storms to the best of our ability with limited ocean tide controls.

    Deal Lake, its tributaries and watershed are regulated by Federal and State agencies. Check before you dig.

    Strict compliance with the NJDEP regulations apply to any land 50 feet adjacent to the Deal Lake shoreline as well as any land 50 feet adjacent to any stream that drains into Deal Lake.

    Property owners should contact the NJDEP before beginning any maintenance or any construction along the lake's shoreline.

    There can be consequences, including fines and time delays for proceeding with work, prior to securing the appropriate NJDEP permit(s).

    FEBRUARY 20, 2025

     

    The Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform.  The Commission Chairman called the meeting to order at 7:00 PM.  After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 6, 2025, posting where required and filing a copy of the notice with the Commission Clerk.  The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

    OLD BUSINESS

     

    1. 2022 NJDEP Stormwater Management Grant for Seaview Mall – Peter Avakian, Deal Lake Commission Engineer, explained that we have not been authorized to perform any additional conceptual design by the DEP until the grant agreement is signed and returned. The hold up has not been on our part. He went on to express his frustration with the DEP and getting this project going.

     

    Don Brockel, Commission Chairman, said it appears every lake is having similar problems.  We are still waiting for our final payment from the last grant.  When we finally get the agreement, we will request an extension.

     

    1. Shoreline Protection/Education – Jeannie Toher, City of Asbury Park Commissioner, said there is no update, she will reach out to them next week. She went on to say there has been no water testing taking place due to the weather being so cold and the lake being frozen. She will have more to report next month.

     

    Mr. Brockel went on to talk about the problem with recycling blowing down the streets and into the lake in Interlaken and Loch Arbour, with Loch Arbour being worse in the summer.

     

    There was a brief discussion on the subject and some of the measures that could be taken to help alleviate the problem.

     

    1. Reestablishment of a Joint Meeting known as the Deal Lake Commission – The Commission Clerk is working on consolidating the signatures to make a complete renewal agreement for each municipality. Mr. Brockel sent Amendment #2 for review. Amendment #1 has been sent out to the Towns for their review and to vote on it. Amendment #2 changes the vote for major capital expenditures from the DLC Commissioners to the consent in writing by the governing bodies of all the member municipalities.

     

    UPON MOTION of Asbury Park, seconded by Ocean, moved to accept the change in ARTICLE X – FINANCES AND BUDGET exactly as written.

    1. Jessie Joseph, Commission Clerk, gave brief explanation of what a QPA is and by appointing a QPA it gives us the advantage of an increase in our bid and quote threshold.

     

    Resolution #25-022 – Authorizing the Appointment of David G. Brown, II as the Qualified

                                        Purchasing Agent for the Deal Lake Commission

     

                UPON MOTION of Deal, seconded by Loch Arbour, carried that the following Resolution be and the same is hereby adopted:

    WHEREAS, pursuant to N.J.S.A. 40A:11-3(c), adjustments were made to the bid and quote thresholds for awarding contracts by various contracting units; and

     

    WHEREAS, effective July 1, 2020, municipalities that have appointed a Qualified Purchasing Agent pursuant to N.J.S.A. 40A:11-9(b) can take advantage of a higher bid threshold pursuant to N.J.S.A. 40A:11-3(a) and have the maximum bid threshold increased from $40,000.00 to $44,000.00 and the quote threshold from $6,000.00 to $6,600.00; and

     

    WHEREAS, David G. Brown, II, is currently the purchasing agent for the Township of Ocean, and does possess the designation of Qualified Purchasing Agent as issued by the Director of the Division of Local Government Services in accordance with N.J.A.C. 5:34-5 et seq.; and

     

    WHEREAS, it is in the best interest of the Deal Lake Commission to appoint David G. Brown, II as its Qualified Purchasing Agent to take advantage of the increase in the bid and quote threshold; and

     

    NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby appoints David G. Brown, II, as the Qualified Purchasing Agent for the Deal Lake Commission for the period January 1, 2025 through December 31, 2025 at a cost of $125.00, per hour not to exceed $2,000.00, pursuant to N.J.S.A. 40A:11-2(30), with specific relevance to the authority, responsibility and accountability of the purchasing activity of the contracting unit; and

     

    BE IT FUTHER RESOLVED that in accordance with N.J.A.C. 5:34-5.2, the local Unit Commission Clerk is hereby authorized and directed to forward a certified copy of this resolution and a copy of David G. Brown, II’s certification to the Director of Local Government Services.

    1. Authorizing Requests for Proposals for the 2025-2026 Herbicide Treatment at

    Select Areas of Deal Lake

     

                UPON MOTION of Asbury Park, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:

     

    WHEREAS, there exists a need for a herbicide treatment of Deal Lake in the Colonial Terrace, Hollow Brook Cove and other sections of Deal Lake that may be deemed in need of a herbicide treatment.

     

    NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes the Commission Clerk to advertise the Requests for Proposals for the 2025-2026 Herbicide Treatment a select areas of Deal Lake.

    The Deal Lake Commissioners will hold a Closed Session Workshop to discuss the RFQ’s received for the Commission Attorney.

     

    1. Deal Lake Clean-Up – Mr. Brockel said that he was approached by the Kiwanis Club that they would like to do a clean- up with the kids from the Key Club of New Jersey who are coming to Asbury Park for an overnighter. They would like to do something on Friday the 4th to help the community.  Steve from the Kiwanis Club thought it would be a good idea to help the lakes.  He reached out to Sunset and Wesley Lakes and they were in favor of it.  He also has a call in to Tom Pavinski, so the kids could also help clean up the rain gardens.  Its all focused in Asbury Park.

     

    After a brief discussion it was decided to hold the Spring Clean-Up on April 5th at 9:00 AM.  More details to follow.

     

    Margot Fernicola, Village of Loch Arbour Commissioner, announced the Clean Ocean Action Clean Sweep is Saturday, April 12th.

     

    Mr. Brockel had numerous meetings with OEMs from Deal, Ocean, Interlaken, Loch Arbour and Asbury Park.  We will be working together a lot more, especially getting the word out on flooding.  We are all linked together and connected for storms.

     

    Mr. Brockel said Ocean Township came to him with a request for our support on funding.  They are going for special funding for various projects on the western ponds.  It is called the LEAP Grant program and is about $150,000.00.  He will have more for the next meeting.

     

    Ken McGee, Webmaster for the Deal Lake Commission, asked if we are going to continue recording and posting the DLC meetings to the website.  The biggest problem he has with the in-person meeting is the quality of the sound and not being able to see the person speaking.  It is something we need to work on.

     

    There was a discussion on the meetings and staying hybrid.

     

     

     

     

     

    COMMISSIONER’S LAST WORD

     

    Margot Fernicola, Village of Loch Arbour Commissioner, commented on a lot of garbage blowing down to the lake during the last wind storm.  She is working with the Village Commissioners to remind people to secure their garbage and recyclables.

     

    Carolyn Roarty, Borough of Interlaken Commissioner, with respect to in-person meetings, she feels we need to get more young people involved to set ourselves up for the future with younger adults and youth programs.

     

    PUBLIC HEARING

     

    UPON MOTION of Interlaken, seconded by Loch Arbour, moved that the meeting be opened to the public.

     

    Brian Mullins, Ocean Township resident, asked that the shared services that Ocean Township is looking for has Hollow Brook on the list.

     

                There being no further comments and UPON MOTION of Ocean, seconded by Interlaken, carried that the public hearing be closed.  There being no further business and UPON MOTION Ocean, seconded by Interlaken, carried that the meeting be finally adjourned at 8:08 PM.
