The DLC was chartered in 1974 by the 7 shore line towns. Our mission is to provide leadership, guidance, and resources to preserve and restore Deal Lake and its tributaries as a healthy and stable ecosystem. In addition, control lake levels during heavy storms to the best of our ability with limited ocean tide controls.

    Deal Lake, its tributaries and watershed are regulated by Federal and State agencies. Check before you dig.

    Strict compliance with the NJDEP regulations apply to any land 50 feet adjacent to the Deal Lake shoreline as well as any land 50 feet adjacent to any stream that drains into Deal Lake.

    Property owners should contact the NJDEP before beginning any maintenance or any construction along the lake's shoreline.

    There can be consequences, including fines and time delays for proceeding with work, prior to securing the appropriate NJDEP permit(s).

    JULY 25, 2024

     

    The Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform.  The Commission Chairman called the meeting to order at 7:00 PM.  After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 1, 2024, posting where required and filing a copy of the notice with the Commission Clerk.  The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

    OLD BUSINESS

     

    1. 319(H) Grant (2017) – Don Brockel, Commission Chairman, said we just received the check today from the State in the amount of $93,000.00. Once they approve the one budget item they wanted changed, we should be receiving the rest of money.

     

    Jeannie Toher, City of Asbury Park Commissioner, asked for an explanation of the resolution that we are voting on.

     

    Mr. Brockel explained we did not have the funds to pay Precise Construction, Inc. the final $10,000.00 that is owed to them.  This resolution gives the CFO the authority to issue the check prior to the next meeting once the funds are received and deposited.

     

    Resolution #24-044 – Authorizing Final Payment of $10,000.00 to Precise Construction,    

    Inc. for the Ocean Grove Wesley Lake Rain Gardens and Tree Well Bioretention System as part of the 2017 319(H) Grant

     

                UPON MOTION of Interlaken, seconded by Loch Arbour, carried that the following Resolution be and the same is hereby adopted:

     

    WHEREAS, as part of the SY2017 319(H) Grant the Deal Lake Commission awarded a contract to Precise Construction, Inc., Freehold, NJ for the Ocean Grove Wesley Lake Rain Gardens and One (1) Tree Well Bioretention System by way of Resolution #22-044 dated August 18, 2022 at a cost not to exceed $166,840.00; and

     

    WHEREAS, subsequent to the work being done on the final phase of the project, it was determined that additional work was needed for the installation of the tree well in the Borough of Allenhurst; and

     

    WHEREAS, the change resulted in an increase of $11,810.00 in the approved contract amount from $166,840.00 to $178,650.00 which was approved by way of Resolution #24-024 dated February 15, 2024; and

     

    WHEREAS, the Deal Lake Commission has paid Precise Construction, Inc. $158,650.00 of the total $178,650.00; and

    WHEREAS, the Deal Lake Commission authorized a partial payment of $10,000.00 to Precise Construction, Inc. by way of Resolution #24-041 dated June 25, 2024; and

     

    WHEREAS, the Deal Lake Commission is still waiting for reimbursement from the State of New Jersey in the amount of $93,000.00; and

     

    WHEREAS, the Deal Lake Commission hereby authorizes the final payment of $10,000.00 to Precise Construction, Inc., upon receipt of the payment from the State of New Jersey.

     

    NOW, THEREFORE BE IT RESOLVED by the Deal Lake Commission that they hereby authorize the final payment of $10,000.00 to Precise Construction, Inc., Freehold, NJ for the Ocean Grove Wesley Lake Rain Gardens and Tree Well Bioretention Systems as part of the SY2017 319(H) Grant, upon receipt of payment from int State of New Jersey in the amount of $93,000.00.

    1. New DEP Stormwater Management Grant – Mr. Brockel said it’s still in limbo because of the insurance issue. We were able to resolve our prior insurance issue for the 319 Grant, but going forward the DLC needs to have it’ own liability insurance. We are in the process of working with Interlaken on the insurance.  He spoke briefly about the DLC’s insurance needs.

     

    Peter Avakian, Commission Engineer, had comments and concerns regarding this grant.  We are 1 ½ years into a 3-year grant Agreement. We completed our work and submitted it quickly and have been waiting for over a year to get the Agreement signed by the State of New Jersey.  The State did agree in writing to upfront money for the design work before it’s expended.  Once we have the Agreement we can actually process a request for funding to cover the cost of the work already done by the Commission Engineer and Environmental Consultant.  He suggests we request an extension.  He also had comments about an e-mail that was received from the Deal Lake Watershed Alliance taking credit for the DLC’s green infrastructure design.

     

    1. Shoreline Protection/Education – No Update.

     

    1. Goose/Carp Remediation – No Update.

     

    1. 2024 Weed Management Program – Mr. Brockel said the lake is looking good and there is no need for a treatment at this time.

    Ms. Toher asked when we would be discussing the treatment along Deal Lake for geese.

     

    Mr. Brockel explained that we did that as a sample and it was not a permanent project.  With the outstanding monies owed to the DLC, it has not been on the radar to try it again.  He will reach out to the Contractor that did the treatment last year and find out the cost and the best to time to do the treatment.  He will have an answer at the next meeting.

     

    1. Renewal of the 2025-2035 Agreement for the Reestablishment of a Joint Meeting known as the Deal Lake Commission – Jessie Joseph, Commission Clerk, reported that Allenhurst, Deal, Loch Arbour and Ocean have all renewed the Agreement.

     

    Mr. Avakian will be meeting with the Mayor and Clerk from Interlaken to go over the insurance information that is now required by the DEP for all grants.

     

    NEW BUSINESS

     

    1. Mr. Brockel reported that Allenhurst will be installing three fountains in the lake north of the bridge. They are also working on a fishing tournament.

     

    1. Mr. Brockel did not have an update on the oil spill on Memorial Drive. They did a great job cleaning it up.  He will be contacting them to see what the next step is in determining what affect it had on the lake.

     

    Dr. Stephen Souza, Commission Environmental Consultant, gave a brief outline of what the next steps should be.

     

    There was more discussion on the oil spill.  Mr. Brockel said the MTD that the DLC had  installed on Memorial Drive was cleaned out again for extra effort.

     

    1. Ms. Toher said she did a letter to go along with the guide to the lake that she will be sending to new homeowners along the lake. They will be sending it out shortly.

     

    PUBLIC HEARING

     

    UPON MOTION of Interlaken, seconded by Asbury Park, moved that the meeting be opened to the public.

     

    Brian Mullins, Ocean Township, asked what is the Grant for?

     

    Mr. Avakian gave him a brief explanation of the Grant and invited him to his office to see the plans for the project.

    COMMISSIONER’S LAST WORD

     

    Carolyn Roarty, Borough of Interlaken Commissioner, said we need to start thinking about the 50th Anniversary Celebration of the Deal Lake Commission.

     

    Don Brockel, Chairman and Township of Ocean Commissioners, thanked everyone that has taken pictures of and on the Lake.

     

    It was decided to have a Workshop Meeting at 6:30PM prior to the August 15th Meeting to discuss the 50th Anniversary Celebration.  It was decided to have the August 15th Workshop and Regular Meeting be a Zoom Meeting Only.

     

    There being no further business and UPON MOTION Loch Arbour, seconded by Asbury Park, carried that the meeting be finally adjourned at 7:42 PM.
