MINUTES – REGULAR MEETING
May 19, 2022
Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform. The Commission Chairman called the meeting to order at 6:00 PM. After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 2, 2022, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 30.

UPON MOTION of Asbury Park, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:
BE IT RESOLVED that the Minutes of the Regular Meeting of the Deal Lake Commission held on April 21, 2022 be and the same are hereby approved (Deal does not vote).

OLD BUSINESS
- 319(H) Grant –Peter Avakian, Commission Engineer, reported that the MTD portion of the project is complete as well as the floating wetland islands and the rain garden in Asbury Park. The next phase of the project is the Ocean Grove Wesley Lake rain gardens and the tree boxes. He gave a brief explanation of the locations for the rain gardens and their function. We authorized receipt of bids for the installation of the rain gardens at the previous meeting. We advertised for bids to be received on June 14th and after review, we hope to award the contract at the June meeting. The Tree Box Proposals should be completed soon.
- 319 Grant Phase I with NJIT – No Update.
- Nobility Crest – Hunt Parry, Commission Attorney, said he has reached out to the Attorney for the Developer and there is still no response.
- Shoreline Protection/Education – Jeannie Toher, Asbury Park Commissioner, read from a prepared statement in which she said she would like to continue with the shoreline protection educational pamphlet but this pamphlet would target non-lakefront homeowners.
Resolution #22-034 – Authorize the Deal Lake Commission to Publish a Brochure Related
to Lakefront Rules and Regulations for Non-Lakefront Residents
UPON MOTION of Asbury Park, seconded by ocean, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, there exists a need to educate homeowners that do not live directly on the lake about the impact of the actions that they take at their homes and how it impacts the lake; and
WHEREAS, the Deal Lake Commission has previously developed and distributed an educational brochure to lakefront homeowners, planning and zoning boards, realtors and the seven municipalities that make-up the Deal Lake Commission; and

NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes the publication and distribution of educational brochures targeting non-lakefront homeowners in an amount not to exceed $500.00.

- Goose/Carp Remediation – Mr. Brockel said the carp will be discussed next month.
- Ship & Sniff Program with Clean Ocean Action – No Update.
- Restoration of 4 lakes/ponds west of Wickapecko and Seaview Mall – No Update.
- Water Testing: Monmouth University – Ms. Toher said they have a need for another citizen scientist.
- 2022 Weed Treat Program – No Update.
- New 319 Grant Submission – No Update.
- New DEP Grant – Mr. Avakian said the grant that we are applying for would help with the drainage corridor around Seaview Square Mall. We hope to have it submitted electronically to the DEP by Friday of next week. This would be a FY2022 319 Grant. There was a brief discussion on the grant and the history of the location we are looking to improve.
- Surf Rider Clean-Up July 7th – Mr. Brockel will have more information on the event next month.
- Asbury Park Rotary Event Honoring DLC Chairman Don Brockel – Mr. Brockel announced that the event is sold out. He wanted to thank all of the sponsors of the event. All of the proceeds will be going to the Deal Lake Watershed Alliance.
NEW BUSINESS
- Tree Ordinance – Mr. Brockel said Ocean Township recently amended their tree ordinance. He will forward copies to the Commissioners.
Ms. Toher again read from a prepared statement expressing her support for the tree ordinance and urging each Town to adopt a similar ordinance.

Mr. Brockel asked her to draft up a letter for the next meeting to send to the Commission municipalities.
- Request to Monmouth County Sheriff’s Office to help with enforcement of boating rules on the lake – To be held for the next meeting
- Resolution #22-035 – Recognizing July 2022 as Lake Appreciation Month
UPON MOTION of Asbury Park, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, lakes and reservoirs are among New Jersey’s most valuable natural resources; and
WHEREAS, lakes and reservoirs provide drinking water, irrigation, energy, recreation, scenic beauty and habitat for wildlife; and
WHEREAS, these beneficial uses have been of vital importance to New Jersey’s history, growth and financial health; and
WHEREAS, our lakes and reservoirs improve the quality of life for all of New Jersey’s residents and their importance should not go unnoticed; and
WHEREAS, the State of New Jersey recognizes the need to protect these lakes and reservoirs for future generations.
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby proclaims JULY 2022 as LAKE APPRECIATION MONTH in the State ofr New Jersey and invite all citizens to take due note of the observance.

- 2022 NALMS Student Poster Contest – Ms. Toher reported that the NALMS Poster Contest is going on now. She did send the contest to Asbury Park Schools and requested that the teachers said any submissions to the DLC also, so we can put them on our website. There is prize money and it goes to the school.
COMMISSIONER’S LAST WORD

Tony Mauro, Borough of Allenhurst Alternate Commissioner, commented on how much the DLC has accomplished in the past few years.
Carolyn Roarty, Interlaken Commissioner, asked if we would consider tracking some of the different items that are collected during clean-ups. It would be interesting to see how our efforts are doing. She also suggested offering a prize for the most unusual object found.
Melanie Nowlin, Village of Loch Arbour Alternate Commissioner, said they have been talking with ANJEC regarding pesticide use around the lake. Loch Arbour is also working on a Tree Ordinance.
Jeannie Toher, Asbury Park Commissioner, again wanted to discuss the information that should be contained in the new pamphlet.
Eric Houghtaling, Neptune Commissioner, reported on the restoration of the monuments at the entrance to Ocean Grove.
Don Brockel, Chairman and Township of Ocean Commissioner, signs up on Main Street bridge about safe passage. Received a call from the Rotary about putting up osprey stands.
Mr. Avakian gave a brief update on the project at the old Coca Cola plant on the Asbury Park circle.
PUBLIC HEARING
UPON MOTION of Asbury Park, seconded by Interlaken, moved that the meeting be opened to the public.
James Veach, had comments regarding Ocean Township’s Tree Ordinance. He also wanted to show his support for the new educational pamphlet.
There being no further comments and UPON MOTION of Ocean, seconded by Allenhurst, carried that the public hearing be closed. There being no further business and UPON MOTION of Ocean, seconded by Interlaken, carried that the meeting be finally adjourned at 6:50 PM.
