MINUTES – REGULAR MEETING
OCTOBER 17, 2024
The Regular Meeting of the Deal Lake Commission was held In-Peron and via teleconference using the Zoom Meeting Platform. The Commission Chairman called the meeting to order at 7:00 PM. After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 1, 2024, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

UPON MOTION of Asbury Park, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:
BE IT RESOLVED that the Minutes of the Regular Meeting of the Deal Lake Commission held on September 19, 2024 be and the same are hereby approved (Neptune does not vote).

OLD BUSINESS
- DEP Stormwater Management Grant for Seaview Mall – Don Brockel, Commission Chairman, reported that we are still waiting for insurance paperwork from Ocean so we can submit it to the State. The State will not sign off on the Grant Agreement until the insurance is submitted. He went on to report we are still waiting for reimbursement from State for the previous grant.
- Shoreline Protection/Education – Mr. Brockel has responded to a Freshwater Wetlands Permit request from the DEP for 520 Corlies Avenue. He received the letter as a civilian because he is an adjacent property owner. He suggested drafting a letter to the Towns from the DLC to let us know when they will be doing work on the shoreline.
Bruce Fromer, Commissioner from the Borough of Allenhurst, wanted to stress the importance of the Towns alerting the DLC and the DEP whenever they are thinking of doing work adjacent to the shoreline.
Ms. Toher brought up the brochure that she worked on and was distributed to each Town that contained a paragraph about doing any kind of work on the lake. She would like to see that paragraph placed on construction permits issued to lakefront homeowners.
The was more discussion on the importance of getting a letter out to the Towns regarding this issue.
Mr. Brockel also reminded everyone that the Corlies Avenue Bridge is slated to be torn down and rebuilt.

Dr. Stephen Souza, DLC Environmental Consultant, gave a brief update of the new MS4 Stormwater Management requirements.
- Goose/Carp Remediation – Mr. Brockel went over the 2024 USDA report on the goose management treatment. The USDA treated 46 eggs and 11 nests this year. In 2023 they treated 34 eggs and 10 nests.
The Commission Clerk will be sending out the bills for the 2024 Goose Remediation to the Towns. She will also send each Town’s DLC Commissioner a copy of the letter and invoice being sent to their Town.
- Reestablishment of a Joint Meeting known as the Deal Lake Commission – Mr. Brockel said the Resolution and Addendum are finalized and will be sent to each Town for their adoption. We are still waiting for Asbury Park to sign the original renewal Agreement.
- 2024 Deal Lake Fall Clean-Up – Mr. Brockel reminded everyone that the fall clean-up is November 9th. We will start lowering the lake on the night of November 3rd. We will again have the students from Monmouth University participating as well as the students from the Wanamassa School.
Dr. Souza wanted to make sure we record all in-kind services for the new Grant.
Ms. Toher notified the Superintendent of the Asbury Park DPW and they will be cleaning out the MTD’s.
Resolution #24-053 – Authorize the Commission Clerk to advertise the 2024 Deal Lake Fall
Clean-Up in an amount not to exceed $400.00
UPON MOTION of Ocean, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, the Deal Lake Commission sponsors an annual fall clean-up to remove accumulated debris and trash from the watershed; and
NOW, THEREFORE, BE IT RESOLVED that the 2024 Fall Clean-Up be scheduled for November 9, 2024 from 9:00 AM to Noon and the Commission Clerk, be and she is hereby directed to place an ad in The Coaster to include information noted above and alerting residents of the lake lowering with regard to the November 9, 2024 Clean-Up and the blowing of leaves in the lake in an amount not to exceed $400.00

Resolution #24-054 – Authorize the Commission Chairman to purchase supplies for the
2024 Deal Lake Fall Clean-Up in an amount not to exceed $300.00
UPON MOTION of Allenhurst, seconded by Deal, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, there exists a need to purchase supplies, from time to time, for clean-ups that are sponsored by the Deal Lake Commission; and
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorize the Chairman of the Deal Lake Commission or his designee, to purchase supplies for the 2024 Deal Lake Fall Clean-Up in an amount not to exceed $300.00

NEW BUSINESS
- Flume Ownership – Mr. Fromer said the project was to try and make a determination as to the ownership of the flume. After going out to the site, it appears that the gatehouse, the flume, the sluice gates, the outfall, etc. all appeared to look like it was right on the border between Loch Arbour and Asbury Park. After reviewing documents, maps and sketches there is no clear answer as to who owns the flume. The Deal Lake Commission has been the ones putting up the money and getting the Grants to do the improvements. The conclusion we came to is the State is the owner of the lake, the two towns own the property where the flume and gatehouse are located and the DLC is responsible for being the custodians of the health of the lake.
Peter Avakian, Commission Engineer, thanked Mr. Fromer for his work on this project. As a result of this project, we will now have a map that shows the lake, the gatehouse, the flume crossing Ocean Avenue, the flume extending to the surge chamber and from the surge chamber approximately 400 feet further to the outfall which now occurs in the middle of Deal Lake Jetty.
- Meetings – Mr. Brockel said the next meeting is December 5th and he asked if they would like it to be 100% Zoom or hybrid. It was decided to do the meeting hybrid. There will be more discussion on future meetings at the December meeting, especially after tonight’s meeting being hacked twice.

Kenneth McGee, Webmaster, suggested locking the meeting after a certain time. He also suggested changing the meeting code and requiring people to have a recognizable name.
COMMISSIONER’S LAST WORD
Carolyn Roarty, Borough of Interlaken Commissioner, has noticed a lot of submerged material along the shoreline and is hoping the clean-up will help take care of that. Thanked Bruce Fromer for the information on the flume.
Margot Fernicola, Village of Loch Arbour Commissioner, reminded everyone that the Clean Ocean Action Beach Sweep will be held on October 19th from 9:00 AM to 12:30 PM. Reported that a house in Loch Arbour that is under construction is sweeping their debris into the storm drain. What can a citizen do when they see something like this.
Bobbi Coffey, Borough of Deal Commissioner, announced that Deal is raising their beach fees.
Jeannie Toher, City of Asbury Park Commissioner, she and Josh Starner the Alternate Commissioner from Asbury Park, have been working on the letters for the new homeowners along the lake. Included in the letter is the pamphlet and our card so the people can get on our e-mail List.
Mr. Starner explained how he got the names and addresses. He went on to say 33 letters were put in the mail today.
Ms. Toher pointed out that there were over 300 letters that were hand delivered and with the price of postage did we still want to send out letters by mail. She would like to start working on another pamphlet for homeowners that are away from the lakefront and would like people’s input.
Mr. Brockel said that we will revisit that next year.
Bruce Fromer, Borough of Allenhurst Commissioner, suggested placing signs around the storm drain inlets as a good boy scout project.
