MINUTES – REGULAR MEETING
OCTOBER 19, 2023
Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform. The Commission Chairman called the meeting to order at 7:00 PM. After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 2, 2022, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

Resolution #23-050 – Resolution to Approve the Minutes of the Regular Meeting
September 21, 2023
UPON MOTION of Asbury Park, seconded by Allenhurst, carried that the following Resolution be and the same is hereby adopted:
NOW, THEREFORE, BE IT RESOLVED that the Minutes of the Regular Meeting of the Deal Lake Commission held on September 21, 2023 be and the same are hereby approved (Deal and Neptune do not vote).

OLD BUSINESS
- 2017 – 319(H) Grant – Don Brockel, Commission Chairman, said the tree box will be installed by the gazebo in Allenhurst on October 24th. That is the final piece of the grant. Once that is complete we will be submitting the final paperwork for reimbursement.
- Shoreline Protection/Education – No Update.
- Goose/Carp Remediation – No Update.
- Restoration of 4 lakes/ponds west of Wickapecko – Mr. Brockel said there is no update at this time but someone did send him pictures of what appears to be samples being taken at Terrace Pond.
- New DEP Stormwater Management Grant – Mr. Brockel reported that the Grant we have for Seaview Mall is still being finalized. He hopes to have a report for the next meeting.
- Fall Clean-Up – Mr. Brockel reminded everyone that the Fall Clean-Up is this Saturday at 9 am at the Asbury Park Boat Ramp. Monmouth University is involved again this year.
Dr. Stephen Souza, DLC Environment Consultant, wanted to remind the Chairman to get an accurate head count of attendees of the clean-up. We need that for our in-kind service match for the Grant.
Jeannie Toher, City of Asbury Park Commissioner, wanted to remind the Commissioners to hand out the new DLC business cards at the clean-up.
- Dr. Souza reported that someone sent him pictures of the Ocean Grove Rain Garden working really well during the recent storm.

Ms. Toher mentioned that the DLC had discussed putting up a sign to let people know it’s a Rain Garden at Wesley Lake.
Mr. Brockel said the Wesley Lake Commission is handling that.
Gail from the Welsey Lake Commission, reported that the sign has been designed and will read “This is a Rain Garden – Do Not Mow.” The signs will be placed at each of the rain gardens.
NEW BUSINESS
- September 29th Storm – Mr. Brockel spoke about the storm and its devastating effects on the lake. It was a battle all week to try and keep the water down. The remote system worked but with 7 inches of rain in one day, plus the full moon and high tide, it was just too much.
*7:19 p.m. Eric Houghtaling, Township of Neptune Commissioner arrived at the meeting.
He went on to speak about some of the lessons that were learned from this storm, such as better notification to residents that live along the lake to warn them that flooding could occur in the next few hours. He will be working with the OEM’s from the different towns to see if we can come up with a plan on alerting people that there is a potential for flooding.
There was more discussion on the flooding not just on the lake but all over.
Ms. Toher would like to thank the Monmouth County Departments that helped us out after the storm.
Mr. Brockel said he had reached out to the Monmouth County Clean Communities that helped us out during our clean-ups and they dropped off a dumpster for the debris. Loch Arbour and Asbury Park have also done a great job in helping us remove debris. The County sent in a team to help remove debris that was in the lake.
- Army Corp of Engineers Opportunities – Mr. Brockel spoke to Jason Shay from the ACoE who suggested to him that the DLC should apply for a flood plan management study on Deal Lake.
Dr. Souza gave a brief explanation of the updated DEP flood hazard and stormwater management regulations. The DEP is now requiring new developments that are coming in to use projected rainfall data as opposed to historical rainfall data because of the intense storms that have taken place in the past few years.

Margot Fernicola, Village of Loch Arbour Commissioner, reported on the following:
- Regrets that she will not be able to help at the DLC Fall Clean-Up but she will be conducting the Clean Ocean Action Beach Sweep in Loch Arbour and Allenhurst on Saturday.
- The Village of Loch Arbour has hired Burke Construction to fix the damaged bulkhead.
- Would like to see the rumor addressed that the flume was not open during the storm. Apparently, it went through on one of the emergency services that the flume was closed.
- She wanted to thank Mr. Brockel for all of his help during the storm
Mr. Brockel said the flume was open and the only time it was closed was during high tides.
Jeannie Toher, City of Asbury Park Commissioner, read from a prepared statement requesting the DLC set aside time in January for a Workshop Meeting to discuss goals for 2024.
Mr. Brockel would like each Commissioner to send him a list of five goals for the coming year. He will consolidate the goals and present them at the January meeting. If the DLC is going to do any kind of Workshop is will be on flood preparedness.
PUBLIC HEARING
UPON MOTION of Allenhurst, seconded by Asbury Park, moved that the meeting be opened to the public.
Melanie Nowlin, Loch Arbour resident, suggested educating the public on how the flume works.
Mr. Brockel said that was a good idea. Someone had suggested having an open house at the flume to show the public how the flume works. He also wanted to let the public know he posts on the DLC website and Facebook when the flume is open and if you are riding by the flume and the green lights are on, that means the flume is open.
Jana Manning, is with the Asbury Park Green Team and she shared some of their mission and goals which seem to align with the goals of the Deal Lake Commission, especially as it relates to infrastructure and stormwater management. She would like to know who designed our rain gardens and was hoping to get their guidance as it appears it is something new to the City’s Engineer.
Dr. Souza explained all of the green infrastructure projects that have been conducted by the DLC have been designed by Leon S. Avakian, Inc. and Princeton Hydro. The DLC has been

following standard procedures that are in within DEP guidance. We also have held education seminars for the DPW personnel on how to maintain the rain gardens.
Ms. Manning went on to say that the Green Team has formed a sub-committee called the Coastal Resilience Sub-Committee and she would like to invite everyone to the Zoom Meeting on October 31st.
There being no further comments and UPON MOTION of Neptune, seconded by Allenhurst, carried that the public hearing be closed. There being no further business and UPON MOTION Allenhurst, seconded by Loch Arbour, carried that the meeting be finally adjourned at 7:47PM.
