MINUTES – REGULAR MEETING
September 15, 2022
Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform. The Commission Chairman called the meeting to order at 7:00 PM. After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 2, 2022, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 28.

OLD BUSINESS
- 319(H) Grant Update – Don Brockel, Commission Chairman, said we are on the last phase of the grant.
Dr. Jack Szczepanski, Environmental Consultant for the 319H Grant, reported that he sent in a request to NJDEP for a no cost time extension for the Grant. The project might begin by mid-November but it doesn’t appear it will be completed until sometime in 2023. The Contractor is having material delivery issues and delays. He feels confident we should get the time extension since we are not asking for more money and supply chain issues are pretty common right now.
- 319 Grant Phase I with NJIT – Mr. Brockel shared photos of the algae eating machine on Deal Lake. They will be available for viewing on the DLC website.
Dr. Stephen Souza, Environmental Consultant for the DLC, said he has not seen any results yet. He gave a brief explanation of what the machine actually does.
- Nobility Crest – Mr. Brockel said there is no update.
- Shoreline Protection/Education – Ms. Toher will be reaching out to DEP to set up a meeting between some of the DLC professionals and the enforcement people.
- Goose/Carp Remediation – Mr. Brockel said no update on the carp remediation. Goose remediation: He sent an e-mail to the Commissioners regarding the DLC working with the USDA to take over goose remediation for the lake and what the cost will be for each town. Right now some of the towns are not participating and by the DLC taking it over we can make sure the whole lake is covered. He would like each Commissioner advise their town of what the DLC is planning and the cost. The goal is to have all of the towns participating. This is for public property only. We will vote on this next month.

Jeannie Toher, Asbury Park Commissioner, reported that she spoke to her Mayor and he was very receptive to the idea. She will be sending a letter with the cost breakdown to her City Manager and Mayor.
- Restoration of 4 lakes/ponds west of Wickapecko and Seaview Mall – No Update.
- Water Testing: Monmouth University and Monmouth County – Mr. Brockel said there is no update at this time.
Ms. Toher said Dr. Adolf and his team are still taking and testing samples from the lake. Hopefully they will have a report to present to us at one of our future meetings.
- New DEP Grant: Stormwater Management Grants for Publicly Managed Water Quality Improvements – No Update.
Dr. Souza said the DLC was approached by the Deal Lake Watershed Alliance to team up with them to pursue grant money from the Stormwater Competitive Grant Program. After reviewing the grant he feels the DLC does not fit any of the qualifying requirements. The DLWA was going to pursue it anyway, but has decided not to apply for the grant.
- JCP&L Violation – Mr. Brockel said JCP&L did receive a notice of violation for violating the clean water act. JCP&L did respond and we are still waiting to hear the outcome.
- JCP&L Osprey Nest Removal – Mr. Brockel reported that the Osprey’s are now building two new nests on the JCP&L building in Allenhurst.
- Monmouth County Sheriff’s Department Lake Patrols – Mr. Brockel said the Sheriff’s Department was back on the lake again. This time they did stop one speeder.
NEW BUSINESS
- Resolution #22-050 – Deal Lake Commission Certification of the Annual Audit
UPON MOTION of Interlaken, seconded by Allenhurst, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions; and
WHEREAS, the Annual Report of Audit for the year 2021 has been filed by a Registered Municipal Accountant with the Commission Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the Commission; and

WHEREAS, the members of the Commission have personally reviewed at a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “General Comments” and “Recommendations” as evidenced by the group affidavit for the Commission attached hereto; and
WHEREAS, such resolution of certification shall be adopted by the Commission no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and
WHEREAS, all members of the Commission have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and
WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:
R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date
fixed for compliance, fails or refuses to obey an order of the director (Director of
Local Government Services), under the provisions of this Article, shall be guilty of a
Misdemeanor and, upon conviction, may be fined not more than one thousand dollars
($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit
his/her office.
NOW, THEREFORE, BE IT RESOLVED that the Deal Lake Commission hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

- Fall Lake Clean-Up – Mr. Brockel said we always hold our Fall Clean-Up the same day as Monmouth University’s Big Event. This year the Big Event will be held November 12th.
Resolution #22-051 – Authorizing the Commission Clerk to advertise the 2022 Deal Lake Fall Clean-Up and Lake Lowering

UPON MOTION of Interlaken, seconded by Asbury Park, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, the Deal Lake Commission sponsors an annual fall clean-up to remove accumulated debris and trash from the watershed; and
NOW, THEREFORE, BE IT RESOLVED that the 2022 Fall Clean-Up be scheduled for November 12, 2022 from 9:00 AM to Noon and the Commission Clerk, be and she is hereby directed to place ads in The Coaster to include information noted above and alerting the residents of the lake lowering with regard to the November 12, 2022 Fall Clean-Up and the blowing of leaves in the lake in an amount not to exceed $500.00.

Resolution #22-052 – Authorizing the Deal Lake Commission Chairman to Purchase
Supplies for the 2022 Deal Lake Fall Clean-Up
UPON MOTION of Neptune, seconded by Allenhurst, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, there exists a need to purchase supplies, from time to time, for the clean-ups that are sponsored by the Deal Lake Commission; and
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes the Chairman of the Deal Lake Commission or his designee, to purchase supplies for the 2022 Deal Lake Fall Clean-Up in an amount not to $400.00.

COMMISSIONER’S LAST WORD
Carolyn Roarty, Borough of Interlaken Commissioner, said she has been out on the lake and it’s looking a little greenish but nothing like it has been in the past. She hopes this weekend with the See, Hear, Now concert in town, it remains stable.
Jeannie Toher, City of Asbury Park Commissioner, gave a trash update. DPW will be installing the slabs for the recycling and trash bins this week. She heard from Bob Jazerowski and Michael Burke regarding the fishing line recycling poles. She asked if anyone had a problem with the Rain Barrel project being held on November 5th. There were no objections. She is looking for 20 participates and the cost should be $40.00 per barrel. This will be a true educational seminar.
Bruce Fromer, Borough of Allenhurst Commissioner, reported the Osprey’s have won – they have foiled JCP&L by rebuilding their nests and returning to the area.
Eric Houghtaling, Township of Neptune Commissioner, wanted to remind everyone of the Pound the Pavement 5K Walk & Run being held on October 24th at 10:00 am starting at the Headliner in Neptune. All of the proceeds go the Lustgarten Foundation for Pancreatic Cancer research. On October 25th the monument between Asbury Park and Ocean Grove will have its re-dedication ceremony at 1:00 pm.
Don Brockel, Chairman and Township of Ocean Commissioner, said he has received a request from Eileen Chapman of Asbury Park, asking if the DLC would like to have a table and participate at the Springwood Park Community Festival October 1st. He will be sending the information to Ms. Toher to see if she is interested in setting up a table.
PUBLIC HEARING
UPON MOTION of Neptune, seconded by Asbury Park, carried that the meeting be opened to the public:
Bob Jazerowski, Ocean Township resident, had the following:
- Asked why Sunset Lake is down about a foot.
- Asked to have the Paddle Tour of the lake on September 24th posted on the DLC website
- He is inviting the DLC team to a Paddle Event on October 1st from 9am – 11am
- Eagle Scout Project – it’s been submitted and needs to be approved. We have five locations picked out for the line recycling poles and there will be educational signs to go along wth the recycling poles.
Mr. Brockel explained that there is a crack in the concrete in the wall which is causing a leak on the southside of Sunset Lake. Asbury Park is aware of the situation.

Mr. Brockel said there was a Clean Ocean Group that came in from Philadelphia called “United by Blue”. We brought them over to Deal Lake and they did a nice job cleaning up the trash by the boat ramp.
There being no further comments and UPON MOTION of Ocean, seconded by Interlaken carried that the public hearing be closed. There being no further business and UPON MOTION of Neptune, seconded by Allenhurst, carried that the meeting be finally adjourned at 7:57 PM.
