MINUTES – REGULAR MEETING
September 30, 2021
Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform. The Commission Chairman called the meeting to order at 7:00 PM. After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 4, 2021and revised on September 16, 2021, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 30.

OLD BUSINESS
- Flume Electrification – Don Brockel, Commission Chairman, said we are waiting for reimbursement for the project.
Peter Avakian, Commission Engineer, said the project is complete and we are waiting for reimbursement.
Jeannie Toher, Asbury Park Commissioner, reported that the DLC webmaster is working to get the webcam up and running on our website.
- 319(H)Grant – Mr. Brockel reported that prep work on Grand Avenue has begun for the MTD installation. Construction should begin next week.
Mr. Avakian gave the following schedule update for the MTD installations:
- Notices were delivered. Tree trimming, clearing and layout started today.
- Mobilize on October 1st and start excavation/installation of the MTD’s.
Weather permitting the installation will be as follows:
- Grand Avenue/Fifth Avenue MTD start on October 4th, one week duration
- Grand Avenue/Sunset Avenue MTD start on October 11th, one week duration
- Memorial Drive MTD start on October 18th, two week duration.
Dr. Jack Szczepanski, DLC Environmental Consultant for the 319(H) Grant – gave a brief update of the project. He said that Tom Pivinski representing the Asbury Park Environmental and Shade Tree Commissions, has completed the final renovations of the Asbury Park rain garden. The plants should be delivered October 5th with planting to begin October 6th. The plants need to be paid for upon delivery and will be reimbursed as part of the 319(H) Grant.

Resolution #21-059 – Authorizing Payment for the Asbury Park Rain Garden Plants as
Part of the 319(H) Grant
UPON MOTION of Allenhurst, seconded by Asbury Park, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, the Deal Lake Commission was awarded a 319(H) Water Quality Restoration Grant dated September 17, 2017; and
WHEREAS, part of the Grant Project includes the restoration of the Asbury Park Rain Garden; and
WHEREAS, Cicconi Farms, Jackson NJ has submitted an invoice in the amount of $3,314.15 for the Asbury Rain Garden Plants; and
WHEREAS, the costs of the Asbury Park rain garden plants will be reimbursed from the 319(H) Grant; and
NOW, THEREFORE BE IT RESOLVED by the Deal Lake Commission, that it hereby authorizes the payment of $3,314.15 to Cicconi Farms, Jackson, NJ for the Asbury Park Rain Garden Plants; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded to the Chief Financial Officer of the Deal Lake Commission for submission for reimbursement as part of the 319(H) Grant Quarterly Report.

- New 319 Grant Phase I with NJIT – No Update.
- Nobility Crest – Hunt Parry, Commission Attorney, announced that he and Mr. Brockel have a meeting scheduled for next week with the Attorney for Nobility Crest.
- Shoreline Protection/Education – Mr. Brockel said there continues to be issues with lakefront property owners and we are still waiting to hear back from the DEP on complaints that were filed.
Ms. Toher, shared the brochure she is working on to educate not only residents that live along the Deal Lake shoreline but the municipalities as well.

After a brief discussion, it was decided to authorize the printing of 1,000 brochures after modifications by the DLC professionals.
Resolution #21-060 – Authorizing the Deal Lake Commission to Publish Brochures Related
to Lakefront Rules and Regulations
UPON MOTION of Asbury Park, seconded by Ocean, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, there exists a need to educate not only lakefront homeowners, but planning boards, zoning boards, realtors and the public to the impact of landscaping and building along the lake front; and
WHEREAS, the Deal Lake Commission has developed a brochure to educate the lakefront homeowners, planning boards, zoning boards, realtors and the public on the impact of landscaping and building along the lake; and
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes the publication of 1,000 educational brochures to be distributed to lakefront homeowners, municipalities and realtors in an amount not to exceed $300.00.

- Coca Cola Plant Update – Mr. Avakian said there is nothing new to report. The Developer will be having their 3rd Public Hearing on the project October 27th at 7:00PM. He pointed out that the Developer is still in the application phase of the project.
- Goose Remediation – Mr. Brockel reminded everyone of the Goose Education Workshop Meeting to be held at 6:00 PM on October 21st prior to our regular meeting. He did receive the reports from the Boroughs of Allenhurst and Interlaken for this year’s goose treatments. Allenhurst: No nests located; no eggs treated. Interlaken: Six nest located; twenty-six eggs treated. He hopes to have Ocean Township’s report for the next meeting.
- Carp Remediation – No Update
- Ship & Sniff Program with Clean Ocean Action – No Update.
- Restoration of 4 lakes/ponds west of Wickapecko – Mr. Brockel said there was an article in today’s Coaster regarding the County’s willingness to lend assistance to Ocean Township in dredging three areas of the lake. It looks like the project cannot begin until 2023.

- Fall Clean-Up – October 23, 2021 (9:00AM-Noon)
Resolution #21-056 – Authorizing the Commission Clerk to advertise the Fall Clean-Up
and Lake Lowering
UPON MOTION of Allenhurst, seconded by Asbury Park, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, the Deal Lake Commission sponsors an annual fall clean-up to remove accumulated debris and trash from the watershed; and
NOW, THEREFORE, BE IT RESOLVED that the 2021 Fall Clean-Up be scheduled for October 23, 2021 from 9:00 AM to Noon and the Commission Clerk, be and she is hereby directed to place ads in The Coaster to include information noted above and alerting the residents of the lake lowering with regard to the October 23rd Clean-Up and the blowing of leaves in the lake in an amount not to exceed $1,000.00.

Resolution #21-057 – Authorizing the Deal Lake Commission Chairman to Purchase
Supplies for the 2021 Deal Lake Fall Clean-Up
UPON MOTION of Allenhurst, seconded by Interlaken, carried that the following Resolution, be and the same is hereby adopted:
WHEREAS, there exists a need to purchase supplies, from time to time, for the clean-ups that are sponsored by the Deal Lake Commission; and
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it hereby authorizes the Chairman of the Deal Lake Commission or his designee, to purchase supplies for the 2021 Deal Lake Fall Clean-Up in an amount not to $400.00.

- Back Bay Study – Mr. Avakian explained that this is study is not designed for watershed flooding. He gave a brief explanation of the Back Bay study.
- Mr. Brockel wanted to thank Ms. Toher for getting Asbury Park to put trash cans on the Sunset Bridge. It will really make a difference. He also wanted to thank the Asbury Park DPW for removing logs by the flume with a backhoe.
- Mr. Brockel said he received a request from a resident to put in an additional public dock in Asbury Park. That request has to go to Asbury Park.
- Juliette Goulet, PhD Environmental Science Department Chair, Brookdale Community College, explained that the EPA has opened up an educational grant that she would like to see as a collaboration between her students and the DLC in promoting environmental issues.

There was more discussion on the subject and how the students could become involved with the DLC.
COMMISSIONER’S LAST WORD
Carolyn Roarty, Borough of Interlaken, sent out kudos to Jeannie for the Autumn news blast.
Tony Mauro, Borough of Allenhurst Alternate, is happy to see that the grants are really moving forward with great projects.
Margot Fernicola, Village of Loch Arbour, also commented on the e-blast. She feels the brochure will be another good tool to alert homeowners of the effects of what they do at their properties and the impact it has on the lake. She is also happy to see that the fall clean-up is the same day as the clean ocean beach sweep.
PUBLIC HEARING
UPON MOTION of Interlaken, seconded by Ocean, carried that the meeting be opened to the public for comments:
Doreen Frega, Animal Protection League, wanted to voice her concerns regarding the geese. She feels there are other methods of achieving permanent solutions to the problem that are non-lethal.
Bob Jaroszewski, asked where the brochures are going to be distributed.
Ms. Toher said they will be distributed throughout the watershed, realtors and municipalities.
There was more discussion on the brochure.
Mr. Jaroszewski requested that the reports received on the geese addling be put on the website.
A resident asked if a dock accessing Deal Lake can be placed in Asbury Park.
Ms. Toher gave brief history of why Asbury Park is not in favor of a dock. It became an insurance issue.
There being no further comments and UPON MOTION of Ocean, seconded by Interlaken, carried that the public hearing be closed. There being no further business and UPON MOTION of Asbury Park, seconded by Interlaken, carried that the meeting be finally adjourned at 8:10 PM.
