MINUTES – REGULAR MEETING
June 20, 2019
The Regular Meeting of the Deal Lake Commission was held in the Borough of Interlaken Municipal Building, 100 Grassmere Avenue, and called to order at 7:00 PM by the Commission Chairman. After the salute to the Flag, the Commission Clerk announced that the notice requirements of Open Public Meetings Act (C.231, P.L. 1975), were met by transmitting the notice to the Commission’s official newspaper on February 7, 2019, posting where required and filing a copy of the notice with the Commission Clerk.

Resolution #19-037 – Resolution to Approve the Minutes of the Regular Meeting,

UPON MOTION of Interlaken, seconded by Allenhurst, carried that the following Resolution be adopted:
BE IT RESOLVED that the Minutes of the Regular Meeting of the Deal Lake Commission held on May 16, 2019 be and the same are hereby approved (Deal and Neptune do not vote).

OLD BUSINESS:
- Flume Electrification – Peter Avakian, Commission Engineer, gave a brief explanation of bid specs. Although seven companies picked up the bids only one company submitted a bid. He recommends awarding the base bid only to Precise Construction, Inc., Freehold, NJ, subject to the review and approval from DEP and the ACoE. He suggests withholding the award of the Alternate Bid Items A1 and A2 until they are reviewed and approved by NJDEP and the ACoE.
Resolution #19-039 – Award of Bid for the Electrification of the Deal Lake Sluice Gates
UPON MOTION of Neptune, seconded by Asbury Park, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, the Deal Lake Commission authorized the Commission Engineer to advertise for the receipt of bids for the Electrification of the Deal Lake Sluice Gates on May 16, 2019; and
WHEREAS, the Commission Engineer did duly advertise to receive bids for the Electrification of the Deal Lake Sluice Gates in The Coaster on May 31, 2019; and
WHEREAS, in connection herewith seven (7) prospective bidders picked up the bid documents: Precise Construction, Inc. Freehold, NJ, T. R. Weniger, Piscataway, NJ, Pillari Bros. Construction Corp., Farmingdale, NJ, Allied Construction Group, Parlin, NJ, Bird Construction, Bayville, NJ, Kappa Construction Corp., Ocean, NJ, Atlantic Subsea,Inc., Bridgeport, NJ; and
WHEREAS, Precise Construction, Inc., Freehold, NJ was the only bid received on June 18, 2019 with a base bid of $363,975.00 and Alternates A-1 thru A-4 in the amount of $180,800.00; and
WHEREAS, the Township Engineer has recommended that a contract for the base bid only be awarded to Precise Construction, Inc., Freehold, NJ, as per their bid proposal for the

Electrification of the Deal Lake Sluice Gates at a cost not to exceed $363,975.00, subject to the review and approval of NJDEP and the ACoE; and
WHEREAS, the Deal Lake Commission Chief Financial Officer has certified to the Deal Lake Commission that there are adequate funds available for the purpose of the award of this contract.
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it does hereby award a contract to Precise Construction, Inc., Freehold, NJ, as per their bid proposal for the Electrification of the Deal Lake Sluice Gates as set forth in their bid submitted for the base bid only in the amount of $363,975.00, subject to the review and approval by NJDEP and the ACoE; and
BE IT FURTHER RESOLVED a certified copy of this Resolution shall be forwarded to the following:
- Precise Construction Inc.
- NJDEP
- Peter R. Avakian, P.E., Commission Engineer
- Commission Chief Financial Officer

- Interlaken to Loch Arbour Bridge – Mr. Brockel said there is no update.
- 319(H) Grant – Mr. Avakian, gave a brief update on the grant. We will be meeting with the Asbury Park Board of Ed to discuss the placement of the MTD by the tennis court area of the Asbury Park High School. We are also working on modifications of the tree boxes for Wesley and Sunset Lakes.
- Organic Material Removal from Fireman’s Pond – No report.
- Water Testing: Monmouth University and Monmouth County – Mr. Brockel said there are no reports or data yet, but there is on-going water testing.
- Ship & Sniff Program with Clean Ocean Action – No update.
- Terrace Pond Depth Study – Mr. Brockel said one piece of the study has been completed but he has not received any of the data.
- Loch Arbour Tree Planting Project – To be held off until the fall.

- Carp Remediation – Dr. Souza, Deal Lake Commission Environmental Consultant, reported that the Proposals are finished.
The Commission Clerk was authorized to advertise the RFP once completed at the May 16, 2019 meeting. It will be advertised in The Coaster on June 27th. The completed RFP must be submitted by July 16th so it can be reviewed and possibly be awarded at the next regular meeting of the DLC.
- Recording of Deal Lake Commission Meetings – Jeannie Toher, Asbury Park Commissioner, reported on the Proposal received from Asbury Park and Ocean Township to share the cost of recording of the DLC meetings. Their proposed amount was $75.00 per meeting. It would cost the DLC $900.00 per year with $450.00 going to Asbury Park and $450.00 going to Ocean Township.
There was a discussion on the recording of the meetings and it was decided to table this subject until the budget is done in October/December. It was suggested that instead of recording all of the meetings, maybe it could be done a few times a year with special presentations.
- Weed Harvesting – Dr. Souza said he had an on-site inspection to go over the details of the weed harvesting in the Colonial Terrace Arm of Deal Lake. Six contractors were sent proposals. Princeton Hydro and Black Lagoon were the only two contractors who showed up for the on-site inspection.
The Proposals are due back on June 26th. Mr. Brockel would like to have a Special Meeting to award the weed harvesting in the Colonial Terrace Arm of Deal Lake project.
Resolution #040-19 –
UPON MOTION of Allenhurst, seconded by Neptune, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, the Commission Clerk advertised for the Receipt of Proposals for Weed Harvesting in the Colonial Terrace Arm of Deal Lake in The Coaster on June 6, 2019; and
WHEREAS, the RFP’s are to be received no later than 3:00 PM on June 26, 2019; and
WHEREAS, time is of the essence for the project and it is necessary to have a Special Meeting to award the Weed Harvesting in the Colonial Terrace Arm of Deal Lake.
NOW, THEREFORE, BI IT RESOLVED by the Deal Lake Commission that it hereby authorizes the Commission Clerk to advertise for a Special Meeting to be held on Thursday, June 27, 2019 at 7:00 PM in the Borough of Interlaken Town Hall for the purpose of awarding the RFP for Weed Harvesting in the Colonial Terrace Arm of Deal Lake.

- Website – Jeannie Toher, reported that the new webmaster is doing a great job. It is still a work in progress but it is more user friendly.
NEW BUSINESS
- Deal Lake Watershed Alliance Fundraiser – Mr. Brockel announced the Deal Lake Watershed Alliance will be holding a fundraiser on July 27, 2109 at 3 Hetricks Point Road, Ocean from 4:00 PM to 7:30 PM. Details are on our website.
- Storm Drains – Mr. Brockel said he met the Ocean Township Mayor to discuss the need to clean-out the storm drains near the lake. They are looking at environmental grants to help with the costs.

UPON MOTION of Allenhurst, seconded by Interlaken, carried that the meeting be opened to the public for comment.

There being no further comments and UPON MOTION of Interlaken, seconded by Ocean, carried that the public hearing be closed. There being no further business and UPON MOTION of Asbury Park, seconded by Interlaken, carried that the meeting be finally adjourned at 8:20 PM.
