March 18, 2021
Due to COVID-19 the Regular Meeting of the Deal Lake Commission was held via teleconference using the Zoom Meeting Platform. The Commission Chairman called the meeting to order at 7:00 PM. After the Salute to the Flag, the Commission Clerk announced that the notice requirements of the Open Public Meetings Act C.231, P.L. 1975, were met by transmitting the notice to the Commission’s official newspaper on February 4, 2021, posting where required and filing a copy of the notice with the Commission Clerk. The Deal Lake Commission meeting will be audio and video taped and will be shown on APTV, Optimum 77 and throughout Monmouth County on FIOS 30.

UPON MOTION of Allenhurst, seconded by Interlaken, carried that the following Resolution be and the same is hereby adopted:

OLD BUSINESS
- Flume Electrification – Don Brockel, Commission Chairman, reported that the flume is fully automated.
Peter Avakian, Commission Engineer, said the main components are complete and he is working with the Contractor to finalize the few remaining items on the punchlist that include the installation of the tide gauges and weather station.
Mr. Brockel again offered to give any of the Mayors and Councilmembers a tour. They can contact him and he will make the arrangements.
- 319(H) Grant – Mr. Avakian gave a brief update and time line regarding the fabrication and installation of the three MTD’s (Manufactured Treatment Devices).
Dr. Jack Szczepaski, Environmental Consultant for the 319(H) Grant, said once the installation dates are confirmed he will reach out to the Asbury Park High School engineering class. He is currently working on an educational presentation on environmental engineering and green infrastructure which he hopes to do with the class next week. The FWI’s (Floating Wetland Islands) are being manufactured and the plants ordered. The renovations to the Asbury Park rain garden will begin this Saturday.

Mr. Avakian gave a brief update on the Wesley Lake rain garden, which is the third component of the grant. He did a walk around of the project with Asbury Park DPW, Neptune DPW and various members of the Wesley Lake Commission. He also met with the Executive Director for the Ocean Grove Camp Meeting Association, while he was very excited about the project, he did have a few concerns regarding the ownership and maintenance of the rain gardens. Once the project is completed an Agreement will need to be done addressing those issues. After the plans are completed, he will present them to the DLC and then to Ocean Grove for their sign off. Once that is done, we will be able to go out to bid for the project. It doesn’t look like that will happen before the end of the summer.
Dr. Szczepanski, said he will look into our request for a time extension on the project.
- New 319 Grant Phase I with NJIT – Mr. Brockel reported that NJIT gave a presentation on their algae eating machine that was well received by the DEP at their meeting last week.
- Nobility Crest – Mr. Brockel said it was confirmed that Nobility Crest did receive our letter and as of today we have not heard back from them.
Jeannie Toher, Asbury Park Commissioner, asked Hunt Parry, Commission Attorney, if there was any information or records for this action that he obtained during his investigation that would help us in pursing legal action against not only Nobility Crest but other lake offenders, now and in the future.
Mr. Parry said the main thing is to report it to DEP and the local municipality, so they have it on record. Also, take and date as many pictures as possible.
- Shoreline Protection/Education – Mr. Brockel said he is working with Ms. Toher on this. He will be following up with the State to get the correct information for the DLC website.
- 2021 Weed Treatment RFP – Dr. Stephen Souza, DLC Environmental Consultant, explained that two bids were received. The lowest responsible bidder was Solitude Lake Management, which did the treatment last year. We will be concentrating on the Colonial Terrace and Hollow Brook sections of the lake. He will be meeting with them in a month to go over their program. They are going to use a quick acting herbicide that doesn’t have any use restrictions, relative to irrigation, which means no issues with the golf course using lake water. Timing is everything with this lake in order for the treatments to work efficiently. The target date to begin is anywhere from May 15th to June 30th.
Resolution #20-034 – Awarding the 2021 Herbicide Treatment at Select Areas of Deal Lake
UPON MOTION of Neptune, seconded by Asbury Park, carried that the following Resolution, be and the same is hereby adopted:

WHEREAS, the Deal Lake Commission wishes to address the problem of excessive weed growth in the Terrace Pond and the Hollow Brook sections of Deal Lake; and
WHEREAS, the Deal Lake Commission authorized Requests for Proposals for the 2021 Herbicide Treatment at Select Areas of Deal Lake on January 21, 2021; and
WHEREAS, the Commission Clerk did duly advertise to receive Proposals for the 2021 Herbicide Treatment at Select Areas of Deal Lake in The Coaster on January 28, 2021; and
WHEREAS, in connection herewith, four (4) Proposals were sent out: Princeton Hydro, LLC; Aquatic Technologies; Solitude Lake Management and Black Lagoon; and
WHEREAS, two (2) Proposals were received on February 16, 2021:

Hollow Brook $ 5,125.00
Solitude Lake Management Terrace Pond $ 3,692.25

WHEREAS, the Deal Lake Commission Chief Financial Officer has certified to the Deal Lake Commission that there are adequate funds available for the purpose of award of this contract.
NOW, THEREFORE, BE IT RESOLVED by the Deal Lake Commission that it does hereby award a contract to Solitude Lake Management, Washington, NJ for the 2021 Herbicide Treatment at Select Areas of Deal Lake – Terrace Pond in the amount of $3,692.25 and the Hollow Brook Section in the amount of $949.76 for a total bid not to exceed $4,642.01; and
BE IT FURTHER RESOLVED that the herbicide treatment shall begin mid-May or sooner depending on the weed growth in the areas to be treated and will be completed by October 31, 2021; and
BE IT FURTHER RESOLVED that Solitude Lake Management shall obtain any necessary DEP permits prior to the application of any herbicides; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be forwarded to the following:
- Solitude Lake Management
- NJDEP

** 7:22 PM – Stevn Kassin, Borough of Deal Commissioner joined the meeting.
- Coca Cola Plant – Dr. Souza said he has no update on the project.
Mr. Avakian said that the Developer was cited for some non-compliant checklist submission requirements, so they were deemed incomplete. They have since resolved the issues and have re-submitted the plans which will now go before the Planning Board.
Dr. Souza pointed out that until the application is complete and ready for review, there is nothing for us to do.
- Goose/Carp Remediation – Mr. Brockel would like to do the same treatment for geese that we did last year except instead of using Rejexit he would like to use Geese Stoppers. The two treatment areas would be the same, Asbury Park Boat Ramp and the Ocean Township location. After a brief discussion it was decided to hold off on this until the next meeting.
- Ship & Sniff Program with Clean Ocean Action – Mr. Brockel said Clean Ocean Action completed the testing and came up with one hot area on Norwood Avenue by the Loch Arbour bridge. We should have a full report for the next meeting.
- Seaview Mall – Mr. Brockel said there is no update. He did speak to the Township Engineer and Planning Board and they will be touring Seaview and looking at the eleven treatment devices that are there.
- Restoration of 4 lakes/ponds west of Wickapecko – Mr. Brockel reported that he spoke to the Mayor of Ocean Township about dredging the lakes west of Wickapecko. It is something that needs to be coordinated with Monmouth County. He will begin the effort but he does have the full support of the Mayor.
- Water Testing: Monmouth University and Monmouth County – Ms. Toher showed the nine areas of the lake that have been tested. She we will reach out to Dr. Adolf and have him come to a meeting to make a short presentation on his findings once the data is compiled.
- Winter/Spring Clean-Up – Carolyn Roarty, Commission Vice-Chairman and Interlaken Commissioner, announced that the clean-up will be held on April 3rd at 9:00 AM at the Asbury Park boat ramp. If volunteers can’t make it that day or want to go out earlier they can.

- Corlies Ave. Bridge (O-10) – Mr. Brockel announced that Monmouth County will be a holding an online public information center meeting on March 24th at 6:00 PM to inform the public of the condition of the bridge and to solicit public input and comment on the project purpose and need. The complete details will be posted on the DLC website and Facebook page.
- Resolution #21-035 – Establishing Rules for the Conduct of Meetings of the Deal Lake
Commission
UPON MOTION of Ocean, seconded by Neptune, carried that the following Resolution be and the same is hereby adopted:
WHEREAS, New Jersey law permits municipalities to establish reasonable rules regarding the length of public comment at meetings of public bodies; and
WHEREAS, for the orderly operation of its meetings, the Commissioners of the Deal Lake Commission finds that it is reasonable and necessary to establish the following rules; and
NOW, THEREFORE, BE IT RESOLVED that the Commissioners of the Deal Lake Commission hereby establishes the following rules for the orderly conduct of meetings of the Deal Lake Commission:
- Public comment shall be limited to three (3) minutes per person at the end of business
- The public can always have their voices heard by the Commission at any time via our web site link: https://deallake.org/about

NEW BUSINESS
- Commissioner’s Last Word
City of Abury Park – Ms. Toher is working with Monmouth County Department of Publics Works to help resolve the issue of drains that aren’t covered on the Asbury Avenue bridge. They will be covering the drains and replacing the curbs. They are in the process of putting together an action plan. Once she has the plan, she will share it with the Commission. She has also reached out to the Asbury Park Public Schools to once again get them involved with the poster contest for Lakes Appreciation Month.
Borough of Interlaken – Ms. Roarty wanted to emphasize how we need to be proactive on educating the public on how important it is to treat goose nests once they are identified.

Village of Loch Arbour – Margot Fernicola, reported on her on-going initiative to make the residents aware that everything they do at their house effects the lake and the ocean. Also, the Beach Sweep, April 17th, 9:00 AM – meet at the public beach entrance at the end of Euclid Avenue.
Township of Neptune – Eric Houghtaling, hopes everyone is well and if you are having a difficult time getting a vaccine appointment, please contact his office and they will help.
PUBLIC HEARING
UPON MOTION of Neptune, seconded by Interlaken, carried that the meeting be opened to the public for comments:
Marty Martino, Township of Ocean, had questions, comments and concerns regarding the following:
- November Meeting – 21 projects for 2021
- Nobility Crest – Copy of letter sent
- Nobility Crest – questioned the DLC Attorney on what steps are being taken to prepare documents to file a suit
Mr. Parry said he has the basic information and he has not been directed to go any further by the DLC.
Mr. Brockel said we are still waiting for the response from Nobility Crest.
Mary Ann Illes, Township of Ocean resident, asked the following:
- Will the walk of Seaview treatment devices be open to the public.
- She is a CloNet volunteer and her site is located on Dittmar, she saw the map and would like to see the key that corresponds to the map.
Mr. Brockel said the walk will not be that is not open to the public, it’s too dangerous.
Ms. Toher said she will get that to her. Dr. Adolf will be at a future meeting to discuss the results.
Brian Mullins, Township of Ocean, had comments and concerns regarding the project on Route 66 where they are widening the road – none of the storm drains have covers.
Rob Jaroszewski, Township of Ocean resident, has concerns regarding the carp
remediation and what it entails and when will it be done.
Dr. Souza gave a brief explanation of the process.
